Discussion regarding General Order 25-2 “Chapter 7 Attorney Requirements” – the why, what and how.

Presented by Brenda Moody Whinery and Krystal Ahart

General Order 25-2 is effective on all Chapter 7 cases filed or converted to Chapter 7 on or after January 15, 2026. Judge Brenda Whinery and Attorney Krystal Ahart will discuss the GO. Judge Whinery will briefly discuss the history leading to the GO. Krystal will discuss practical suggestions for Engagement Agreements, communicating with clients, sending docs to client, and more!

This program is open to everyone in the bankruptcy community, including staff.

Brenda Moody Whinery The Honorable Brenda Moody Whinery serves as a United States Bankruptcy Judge for the District of Arizona, sitting in Tucson. She was appointed to the bench in 2015, following a distinguished career in bankruptcy and commercial litigation. Judge Whinery currently serves as the Chief Bankruptcy Judge for the District of Arizona.

Before joining the bench, Judge Whinery practiced with Mesch, Clark & Rothschild, P.C., where she focused on bankruptcy, creditors’ rights, and commercial litigation. Over her years in private practice, she built a strong reputation for her deep knowledge of bankruptcy law, complex Chapter 11 matters, and commercial dispute resolution.

Judge Whinery is widely recognized for her commitment to legal education and service to the bankruptcy community. She has served on the Ninth Circuit Bankruptcy Judges Education Committee, the Arizona Bankruptcy Court Local Rules Advisory Committee, and has spoken extensively at CLE programs statewide and nationally. She is also active in the Arizona Bankruptcy Inn of Court and continues to mentor lawyers and law students.

In her role as Chief Judge, Judge Whinery has overseen numerous administrative and procedural improvements in the District of Arizona, supported court technology modernization, and maintained a strong focus on accessibility for self-represented debtors.











Krystal Ahart

Krystal Ahart’s desire to be a lawyer began at a very young age (she was voted most likely to become a lawyer in elementary school!). She focuses her practice on assisting individuals and businesses through the bankruptcy process in Chapters 7, 11, and 13. She is an experienced Arizona bankruptcy attorney who has successfully guided many clients through bankruptcy, providing the high-quality, personalized legal advice they need through every phase of their case.

Krystal has been licensed to practice law in the State of Arizona since 2012, after obtaining her Juris Doctor degree at Phoenix School of Law. Krystal started with the law firm of James F. Kahn, P.C., in 2002, moving her way up from file clerk/receptionist, to secretary, to paralegal, and finally to lawyer. She is now a Partner at Kahn & Ahart, PLLC.

Krystal recently became the fourth female to be Certified as a Bankruptcy Specialist by the State Bar of Arizona!

In addition to her work at Bankruptcy Legal Center™, Krystal is an active member of the legal community and devotes a substantial amount of time to serving the underserved. She works closely with the Volunteer Lawyers Program (VLP) on the Friend of the Court Reaffirmation program at the bankruptcy court, where she teaches law students various skills including effective client communication, interviewing, courtroom decorum, and presentation; the law students then represent debtors who don’t have their own attorney at their reaffirmation hearing (as a “Friend of the Court”).

Krystal is a past-president of the Young Lawyers Division Board of the Maricopa County Bar Association and currently serves as Chair of VLP’s Advisory Committee and as Co-Executive Director of Arizona Consumer Bankruptcy Counsel (“ACBC”).
