Chapter 13 Rules in Motion: Confirmation Hearings, Motions to Dismiss, and the New Local Rule Changes

Presented by Rachel Flinn, Chapter 13 attorney for Russell Brown, Lisa Thompson, Chapter 13 attorney for Dianne Kerns, Kimberly Swafford,  Chapter 13 attorney for Edward Maney, and Krystal Ahart, Kahn & Ahart, PLLC.

Arizona Bankruptcy Court General Order 26-4 adopts important amendments to the District of Arizona Chapter 13 Local Rules, effective for cases filed on or after June 1, 2026. This ACBC pop-up seminar will provide a practical overview of the new procedures affecting plan confirmation hearings, creditor objections, trustee recommendations, stipulated confirmation orders, and motions to dismiss.

The program will focus on amended Local Rules 2084-9 through 2084-12, related technical changes to Local Rule 2084-15 and Local Form 2084-4, and what consumer debtor attorneys need to do differently in preparing, filing, noticing, and resolving Chapter 13 plan issues. Key topics include the new objection deadlines, mandatory initial confirmation hearings, attendance requirements, trustee recommendation procedures, confirmation by stipulated order after the initial hearing, and the revised notice requirements for trustee motions to dismiss.

RACHAL FLINN:
Rachel is the staff attorney for Russell Brown, Chapter 13 Trustee. Prior to accepting the staff attorney role in 2015, she represented consumer bankruptcy debtors. In 2008, Rachel obtained her J.D. from Northern Illinois University College of Law.  After graduating from law school, she moved to Arizona and became a member of the Arizona State Bar in May 2009. 


KIM SWAFFORD
: Kim is the former Assistant United States Trustee for the Eastern and Middle Districts of Tennessee.  After 31 years in Tennessee and a brief retirement, Kim served as a Special Assistant AUST for the Executive Office of the United States Trustee working with the San Diego office.  She is a graduate of the University of the Tennessee College of Law and is a former Board member and President of the Mid South Commercial Law Institute and the Bankruptcy Section of the Chattanooga Bar Association.  After becoming licensed in Arizona, Kim began working as an attorney for Chapter 13 Trustee Ed Maney.  


KRYSTAL
M. AHART: Krystal is a partner at Kahn & Ahart, PLLC, dba Bankruptcy Legal Center™, in Arizona. She focuses her practice on representing individual and commercial clients through Chapter 7, 11 (including Sub V), and 13 bankruptcies. Krystal obtained her J.D. from Phoenix School of Law in 2012; she started working with James F. Kahn in 2002, moving her way up from file clerk/receptionist, to secretary, to paralegal, and eventually to lawyer. Krystal became certified as a Bankruptcy Specialist by the State Bar of Arizona in 2020. She was honored to be a member of the 2020 Class of American Bankruptcy Institute’s 40 Under 40 Program and to be on Super Lawyers’ 2021 Southwest Rising Stars® list, an honor reserved for only 2.5 percent of attorneys in the region. Krystal is an active member of the legal community and devotes a substantial amount of time to serving the underserved. She has served as Co-Executive Director of Arizona Consumer Bankruptcy Counsel (ACBC) for nearly five years (servicing as ACBC’s Secretary for years before that), and served as Chair of the Advisory Committee for the Volunteer Lawyers Program for four years before stepping back from that role. In her free time, Krystal enjoys snowboarding, hiking, kayaking, and camping, and also finds the time to serve on her HOA Board. 

LISA C. THOMPSON:
Lisa has practiced business and bankruptcy law for 30+ years.  In 2025, she became part-time Staff Attorney to the Chapter 13 Trustee.  She has learned that she does not aspire to be a Chapter 13 Trustee and is very happy in her job as Staff Attorney.  Lisa no longer files bankruptcy cases but continues to assist businesses in non-bankruptcy options for shut down in preparation for bankruptcy.
